Health Care Reform Law needs to be repealed!!! by Merle Rutledge

Their is always a phrase that you can go back to when looking at some decisions that people will make; whether informed or misinformed. Now I've been a huge supporter of President Barack Obama, but also their has been some policies that I simply do not agree with; and actually support the opposed states; more on this issue than the federal government. Health Care Reform Act can do more harm than good in America. Now some may say oh here we go again! But also, the phrase I was mentioning is that if a deal is too sweet or good, than it more than likely is...

When buyin g a car for example or some jewelry. Whatever floats your boat; as something that you would like to look at, and eventually have; another example is the same as window shopping during christmas time. It looks good on the outside; its advertised very well, it tells you the good, but it falls way short of telling you, how much bad can come with the policy. The bad acourse; more than likely outweighs all this good that you have heard. We have heard the good;as being our children can stay on our insurance until they are 26. The healthcare insurance industry cant deny you for pre existing conditions. This will provide 37 million uninsured with health care coverage and more affordable health care. It sounds like a dream. But snap snap... You wake up and notice that its not a dream, but really a nightmare. The reality of what you really is looking at outweighs the good in the product that you are about to buy. Such as medication meant to cure one ailment while being the catalyst of a new ailment that requires more medication than the last one. This is just one of those bills. I mean this literally! Its the same as going to into the military and being recruited by a sharp tongue officer.

You find out how much benefits that you can get with the contract, but the benefits that will be left off is not being disclosed verbally. It is being disclose in written binding agreement. You sign the papers and than another recruit comes in asking more questions about their contract, having everything thats not in the contract being written in by the officer, and also receiving a signing bonus. Now theirs nothing different about you and this recruit; other than he has decided not to put his name on the dotted line until he was fully aware and had a back up plan for any disputes that may come up in the future. He has a guarantee and now you two going to the same place, and one having more benefits than you. Its no one fault but yourself, because their was absolutely nothing different about what you could have gotten compared to this other recruit. But you learn a huge lesson by this for the future.

So, why are we continuing to make the same mistakes that I thought most people had learned their lesson from. The Health Care Reform Act is over 3,000 pages but it seems like most only read a few paragraphs. The few paragraphs are in huge support, but guaranteed after signing the dotted line, that support will dwindle. Beyond all the maybelline and dressing of the Health Care Reform act is a expensive "bill" We are already in a recession and having a hard time presently paying the bills, that we already have on the table. We are worried more about where we are going to work and how we are going to feed our family; than having this added on bill; as another one, that "we" have to pay. For example, someone that cant afford health insurance has no control of how much money will come out of their income to pay for this insurance year after year. This is more of a middle class or social class killing bill than any other has had on the future.
Also, if you dont pay than you face a monetary penalty as a result. Most have to go from 3 meals to 2 meals a day. Now this bill would put people beyond this point and this can not be good for America. It means either way you pay and will eventually lose income; without no increases. If they are already freezing the private sector pay, but they havent yet figure out a way to freeze other out of control increases in product, goods, and services. All these has increased causing the average American to lose income, confidence, and ability to control and have a balance budget. The same is going on with the states and the federal government at this time. How can a household be able too maintain a balance budget without guessing continuously on the cost of living. We use to be in a time in America that you knew your pay, how much you could spend on luxuries and bills, and also be added on to savings. We no longer live in that time. We knew whether 1000 or 2000 could be spent without going over. Everytime you go to a gas station or even a grocery store; and this doesnt include household bills. The prices are forever changing causing a budget to rapidly eat up needed resources.

After a while people will continue to deep into their savings until its completely depleted; and this sounds like exactly what the government has been doing. We are noticing more and more that the government is the crisis twikle down affect. Its invaded our own houses, family, and loved ones. But, we have to carry the huge burden of this out of control spending. They; meaning the government can ask and recieve payment from citizens Now; while the same citizens dont have the income for now. The citizens income is not increasing and they are being faced with cutting hours, cutting pay with "no insurance," which would mean a additional high bill to pay off a soaring premium, also the time when that pay is going to come back will never happen. The increases in cost will absorb those funds. When you will be able to go back to work; to not only pay off the fine, but to also pay the high and never ending interest that comes with this extra bill. Their would be no limit after a while on how far the government can go. This is America and home of the free; and I do not believe home of lost. If you do not read into this bill than you will definitely be lost with no recourse to fight these measures.

Now Virginia Attorney general and so far 25 other states have decided to fight the U.S Government on the Health Care Reform Act. This fight is one of those that is very important and Im sure AG Cuccinelli would be very shocked at my position on such mandatory bill reform. My term of added on bill with no way to figure out how to pay it off. My reasons for why the Heath Care Reform Act should be ruled unconstitutional. First, it goes against some religions that do not allow doctors to perform even life saving operation on these type of patients, but now you would be forced with paying for a service that you didnt even sign private contract with. They should have the right to deny treatment. This bill forces genea pigs out of citizens for experiments. It would open the flood gates of deception and misinformed consent by doctors, governements, and pharmacy. Its asking for every American to put their signature on a dotted line with a disclaimer full of junk and garbage.
I'm sorry but I do not like a needle forced into my arm; without my permission, and than receiving a new car note as a result. Second, How can we control the costs that is going to take on our way of living. If me or my family gets sick than the government can take money out of my pay or check with increases; that I have no redress for. I shouldnt have to go from upper class to middle class, or to the poverty line; all because of these high end expenses; which dramatically cuts my income. I can easily go from a house to living in a trailer park because my health care insurance takes up too much of my pay. I won't be able to make a payment plan nor negotiate arrangements to control the costs. The costs would be guaranteed whether I dispute it or not. Also, How can I decline the offer on such coverage when I know it is no longer in my budget and god willing that im not sick; that I can go ahead and keep the money for much more important bills. Example, I need water today to take my medication, but due to the health care insurance law.

I have to take medication that requires water, without water. Someone may ask why my water isnt on. We'll its because of the Health Care Reform Act that money I would pay my water bill is being taken from my paycheck. It takes 20 to 30 percent of my pay. The budget I balance for my household did not have this increase in mind; because guess what, I didnt know what it was going to become; until the bill arrived at my door, or the money was sucked out of my check. I'm not in bad health, but now I have no water because of it. It doesnt make a lot of sense. The fees and premiums get higher year by year; as the government makes up more reason to take my money out of income. I wish I would have fought than because I'm not sick, or I have more important emergencies that need my attention. The smart response would be, how about you increase my pay or the minimum wage? Oppss, I forgot we are in a recession is going to be a politician excuse, and also if you have a problem balancing your budget at home, than you can understand how hard it is to balance the budget of the federal government; so politicians need to start acting like it; damn I forgot that always been acting like this.

Their primary focus should be doing everything possile to grow the economy so "we" can afford our own insurance. We can control our own coverage, and we can control our own bills based off what we can afford and not on something being force to control our way of life. So "we" can properly balance our budgets at home. Good credit in this economy is nothing more than life support to a already brain dead patient. It isnt no such thing and I also believe credit reports should be banned as a way of denying employment. It has nothing to do with the qualifications of individuals in this type of economy and society. Their are individuals in America that only have bad credit, because they havent been able to find a job or work that met even their based pay before termination. It isnt because they are not looking for work; its because work isnt trying to hide from them; with good reason. My second point is there are thousans of loopholes in the health care reform act.

If a insurance company wants to deny you coverage than they will find a way. If a car dealership can find a way to get you to buy a car without reading over the full warranty. You just going by word of mouth; than what you get when you take the car back under the warranty; and the dealership says they dont cover the needed repairs. What will you do and this isnt a dealership; this is the federal government. Government will only be taking the place of a well skilled health insurance policy. The underwriting policy will always be to benefit the government by any means to deny you coverage. So dont expect it to be any differently now. Either by controlling and bribing the doctors and pharmacies to cut cost. The cost may also have a dramatic affect on your life. But they will also do their best to make sure they are covered. Remember immunity questions when it comes down to the federal government. Hospitals and doctors would be covered such as sovereign immunity, qualified immunity, all that stuff that says government messed up, but their is no way to recover against that entity.

All the doctors have to be is close enough to right, even if they know that it could be completely wrong. Now based only on the set of facts that a reasonable person in the same situation could come up with possibly the same conclusion. It means the doctor can know you more than likely have cancer, but if you have flu like symptoms. The doctors determine at the time you have the flu and treat you only for the flu. Guess what? You can't sue them even if they know that the possibility of symptoms and your current condition could be cancerous. Malpractice would be a distance claim for relief. Doctors are greedy and if you want examples Medicaid fraud, and bogus billing practices to increase fees. Also, a insurance check to the doctor personally from the company for keeping costs down. But does the insurance company write the doctors or the patient a check for saving a certain number of patients. They will do the same with the government and any other private insurance company. The lone victim to suffer more in the end is "you" the individual.

I like to trust my doctor and know he has my best well being in mind, and not in just my insurance. With the government insurance and those doctors that elect to take up coverage from their insurance. You are going to deal with government doctors, and acourse those that work to keep the cost high, and you continuously down by repetitive treatment. When doctors opt out of the health care reform act, than we will get worse medical treatment than the, doctors that we currently have. Doctors are not require to accept all insurances, except the ones that they deem to be in their best interest. It is a personal decision; and Im very personal, but we all are tempted by the best offer. We will go to a outlet to save 50 dollars on a sweater thats being sold in the mall; with the same value and quality, but only seperate locations. If it is worth it for us to make a trip down a longer street to save money; than we as human will go in that direction. I do not see doctors having any problems in the future with income, and all the funding they get in order to maintain their jobs. I think I would just rather go with the devil I know than the devil I don't. With all these loopholes, like I said, they will find a way to screw "you" over.

It would just be the government doing it twice. I just consider it all "human nature" with a dead end policy. Third, as I continue to slam the Health Care Reform Act, to a loud applause possibly from some parties. This is just one of those issues that I would have to reach across the aisle on. The government should not ever be allowed to overreach as far as to say a United States Citizen of America, has to have insurance or cant afford to live in America. This is the speech that supporters do not give you. Yes it will drive down Health Care Cost on the dime of taxpaying Americans, while giving them the Placebo Effect of being backed up by the same more affordable insurance. "You pay for what you get." If you do not know what a Placebo Effect is, than I'll try to help you out my way. It means, that we as citizens are part of the control group for the government. Placebo Effect only tells you that you are covered; but in no way or means, are you really actually covered as the same; as the experimental group. We allow one group to get government coverage, while the other group thinks they are covered? Both groups dont know what is fully covered; while the other group is fully aware of the converage. My opinion would say, that either group will not experience a significant change on their health due to this experiment. It is only based off pure research and not applied. Now the pure is believing that you are covered but when you get to the doctors office. They start letting you know what you are covered for and not covered for. Now if the doctor tells you normally I'll give a operation for this type of ailment, but due to your coverage; it requires additional treatment. You die the next day, because the government require additional treatment to a much needed emergency operation. Do you think you are fully covered, or you just through so until you actually had to go to a doctor. This practice goes on with insurance companies across the globe all of the time. Now someone with the Placebo Effect ends up getting the life saving treatment. Now guess what, they wasnt covered at all for the same emergency treatment that "you" really needed. The person not covered gets the life saving treatment and you die. Who really benefited in this exchange. The doctor and the placebo effect patient, because the duty of the doctor was to go with his judgment and not with policy language covered in your false believed coverage. We all are going to die one day, but I rather know the truth that death has no escape, than to live thinking that theirs another way around a dead end. Once again redundant because it is. Also, the leader of the Health Care Reform Act has seem to lose confidence in his very own policy. It might be the first time the leader had a chance to read the details inside the policy; instead of telling us the normal advertisement pitch. Once again when I take medication. I'm one of those types that wants to know the side effects; so I know what to do and not to do while on this type of medication. A couple of court battles ruling that government should be a health care insurance provider does that to a leader. Now I pay attention to this because it lets me know that maybe we shouldnt go into overdrive with this policy, because someone is applying brakes at each bump in the road. Now the leader wants to say states can opt out. Im just looking at what's next. Its ok to say I didnt look this whole thing over and maybe repeal is better than just trying to fix a very broke policy. I know in this day and age that health care costs are soaring. It is many people that need serious medical treatment and services. This bill is just simply not the way to do it. We need reform, but we need reform in many other areas that it's needed. Employment, Economy, Jobs, Education, Social Security and man more; that way more important. This allows us to be able to afford such luxuries, while taking care of a family that so desperately needs us, and needs us to be able to take care of the necessities. Right now America, just cant afford another bill. America cant afford to tax its own people wrecklessly; to the point that the everyone, this includes the rich is not pulling their weight in fixing the crisis. In order to bring this economy life, long lasting prosperity, and also the union that "We as Americans Stand Together," and "We Can get through anything together." It just seems like some is forced into the fight, while others are fighting for others to stay out of it. Now I have to sell this act to the doctors. How would the government go about getting doctors to jump on board. I can think of some things such as immunity from liability. Remember, the government has this nice thing called sovereign immunity and qualified immunity, and many more immunities. Immunities basically saying we are wrong, but their is nothing "you" can do about it. Kings cant be sued notion, so the doctors will now become kings. As quasi-public entities, health department authorities which include the likes of doctor's and insurance agencies will often get the government's immunity from lawsuit or special limitations on liability for injuries they cause.

The government will increase its insurance coverages and responsibilities will not increase, and also that the its agents which will include doctors that practice in malpractice from facing liability. It would mean a doctor cant be sued based on the totality of the circumstances, that it was enough facts to draw a reasonable conclusion; whether right or seriously wrong. Also, unless the government decides to take all of its immunity off the table, than it will not be equal protection. Health Care Act just covers it up until you find out the real legal print.

Now also looking at the matter. They say the insurance is more affordable. 2 years from now 1400 premium but if you get the government option its at 1300; but thats more affordable. Now most premiums are between 500 to 800 dollars and thats supposedly cheap in this high market. See people dont realize what more affordable means, but has yet to ask we'll how much do I have to pay. How much you have to pay may change your mind on this Act alone? The government never said the coverage was free. It only mentions that you will pay; and how much has yet to be determined, but if you are a supporter of this law, than why havent you gotten a correct number. The reason is because they hope that costs for insurance is so high than any amount that is cheapter whether by cents or dollars will guarantee their package. So ask the question, "How much will you have to pay now." Im sure its going to be we'll 2014 hasn't hit yet and it will be T.B.A. a.k.a To be Announced. Does that make a lot of sense even going into a basic contract even with a car company.

So lets say I go to see a doctor and they technically cause my death. They would enjoy qualified immunity, because the doctors, nurses, and hospitals will become creatures of the state and federal government. This is a huge bonus for doctors that would normally face a huge civil suit, but instead get to go on as business as usual. It gives doctors a very broad scapel to keep cutting away at on each and every turn.

So, if I was sue to Dr. John Smith. I would be looking at suing him in his individual and official compacity. But since Dr. is a creature or in other words a agent of the state and federal government; acting within the line and scope of his employment than he is immune from liability unless a official policy or custom exists that would deem otherwise. Now I could sue John Smith as a individual, but as long as he can prove he was working for the government and doing government business than it would immune him as a individual because once again he would have qualified immunity. So anyway it goes than as long as a doctor technically causes my death than they cant be sued, the nurses cant be sued, the hospital cant be sue.

A example since I've mention Va Beach. This would be the future of government irresponsibility in which death occurs and even a garbage collector is immune; even though they are directly technically responsible for causing death. The judge sided with the city’s contention that it is protected by sovereign immunity, a legal concept that can protect governments from civil lawsuits arising from incidents that happen in the course of normal public business. Acourse the doctors will be handling public business under the government power. Padrick called garbage collection a “classic sovereign immunity activity.” Padrick should have included body collection a "classic sovereign immunity activity." The city can’t be sued for the death of a homeless man run over and killed on the beach in June by a city trash truck because the accident happened during routine public business, a Circuit Court judge ruled Thursday. The future will have doctors that can't be sued during routine public business.

You want to know the costs, interest rate, and how long you will have to pay. Guess what it is unlimited if the government has its way. Once again have you asked the necessary questions. We need leadership, but we also need people in office that is willing to sacrifice as well as put America people first.

It is a lot of people hurting and change hasnt come soon enough. We need to go back to putting the root into office and allowing the trees and leave to grow instead of putting in weeds. We have a lot of Weeds in Government. We need to all be more informed on relevant issues, and sorry the place where the president is born, and what religion is he, has no influence on our own circumstances. We all come from different parts of this world; whether through the same country or through state. We all have met different people from different backgrounds asking not to be judged by our heritage but by our character. Our own individual need to become successful and also to be a solid neighbor. We all have been victimized in some way or form; but we all have experience by those we consider similiar in views, values, looks, or any other characteristic that you would at first find socially acceptable. We have all been dissapointed in some shape, form or fashion; or otherwise have taken the dissapointment one's place.

I can show clearly even by this article that I could care less about where you are from?, but more so where are you at in a time of emergency/need? Right now you need to be in the front line of this article. Any freedom that we have left is worth fighting for? Your background should be blind to all prejudice eyes. It doesnt matter who you are, when wrong is wrong, than my race has nothing to do with it! Their is nothing really different about Wisconsin than what i'm mentioning here about the Health Care Law. People made a angry decision and got a Governor that look good on the outside, but the inside was corrupt.

Now you can't go back and make a change on this decision. He will always remain governor in your state throughout history; but hopefully you do what I mention earlier; and not repeat it. Anyone following politics very seriously would have known this was going to be the intention of him through party affiliation past. It should be no surprise that the belief is to bring back this old way of ideological thinking. Now the Unions are being affected, when you had every opportunity to put someone into office that would have fought your fight, instead of being on the sideline; only to coach and watch. Just remember in the long run of this battle get your promises in writing. We have seen enough verbal lies on both side of the aisle. Remember comfortable shoes; at those picket lines.
